Terms and Conditions for Kiteborne Energy ApS

Payment

Kiteborne Energy ApS accepts Dankort/Visa-Dankort, VISA, VISA Electron, Mastercard and JCB. Payment is withdrawn from your account once your order is shipped.

All amounts are in DKK. Danske Kroner and include VAT.

Kiteborne Energy ApS uses certified, SSL (Secure Socket Layer) protocol encrypted payment server. This means your payment data can not be read by third part.

Shipping

Kiteborne Energy strives to ship orders within 3-5 weekdays.

Warranty

We offer 1 year warranty and inside Denmark 2 year in accordance with danish law. Our warranty covers flaws in material and fabrication. Software and servers are not included in the warranty.

Warranty does not cover maltreatment, erroneous installation or service of the product.

Kiteborne Energy does not cover cost of return items.

Limitation of Liability

IN NO EVENT WILL WE OR ANY OF OUR AFFILIATES BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, COLLATERAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION THOSE RESULTING FROM LOST PROFITS, LOST DATA, BURGLARY, FIRE, PROPERTY DAMAGE, PERSONAL INJURY OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE Kit-sensor SERVICE, WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY, ARISING FROM OR RELATING TO THE Kit-sensor SERVICE (REGARDLESS OF THE FORM OF ACTION OR CLAIM, E.G. CONTRACT, WARRANTY, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL THEORY) IS LIMITED TO $100. In some locations applicable mandatory law may not allow certain of the limitations described above, in which case such limitations will apply to the maximum extent allowed by such applicable law.

Termination

You may discontinue your use of the Kit-sensor service at any time by notifying us by e-mail that you wish to terminate your account. After we have terminated your account, you will no longer have access to any of your data. We also reserve the right to delete your account and data if your account has been inactive for a period of more than two (2) years.

Violation by you of any of these Terms gives us sole discretion to suspend, refuse or terminate your access to the Kit-sensor Service effective immediately. In such an event, you are obliged to immediately destroy any copies you have made of any portion of the Kit-sensor Service. We may also suspend, refuse, or terminate your access to the Kit-sensor Service, in our sole discretion, if we suspect you are using the Kit-sensor Service for illegal or abusive purposes, if we suspect you are under 18 years old, if your Kit-sensor Service has not been paid as agreed or if you use the Kit-sensor Service in violation of the terms or usage restrictions of your subscription plan.

We may change or discontinue, in whole or in part, the Kit-sensor Service at any time without notice. You acknowledge that we are not liable to you or to any third party for any such action.

Reimbursement

If reimbursement is agreed upon please include your bank account information in the correspondence.

Right of withdrawal

We offer 14 days of withdrawal from receipt of goods. Orders made between 24th November and 24th December are offered right of withdrawal until 14th of January. The customer covers the cost of return shipping.

Notice of withdrawal from purchase must take place within the deadline above. Return shipment shall take place no later than 14 days from notice of withdrawal.

Condition of goods upon return shipment

The customer is liable of damage and otherwise diminished value due to handling out of accordance with product description. Right of withdrawal waives if the product is put in use to a degree that diminishes its reselling value. In this case we can accept return at a reduced reimbursement based on the reduced value of the goods.
In order to receive the full reimbursement the customer can not actually start using the product.

Server and data

The Customer has free subscription online access via our server to their own private and all public Kiteborne sensor data.

Unscheduled maintenance may need to be performed. During this time the server may be off-line. 

This free service may end with reasonable warning to the customer only in case of radical change in company ownership or business model.

Betaling

Kiteborne Energy ApS modtager betaling med Dankort/VISA-Dankort, VISA, VISA Electron, Mastercard og JCB. Betaling vil først blive trukket på din konto, når varen afsendes.

Alle beløb er i DKK. Danske kroner og er inkl. moms.

Kiteborne Energy ApS bruger en godkendt betalingsserver, der krypterer alle dine kortoplysninger med SSL (Secure Socket Layer) protokol. Det betyder, at man ikke kan aflæse dine informationer.

Levering

Kiteborne Energy ApS leverer indenfor 3-5 hverdage. Der tages forbehold for forsinkelse.

Reklamationsret

Der gives 2 års reklamationsret i henhold til købeloven. Vores reklamationsret gælder for fejl i materiale og/eller fabrikation.

Reklamationen gælder ikke fejl eller skader begået ved forkert betjening af produktet / ydelsen.

Kiteborne Energy ApS dække returneringsomkostninger i et rimeligt omfang.

Der modtages ikke pakker sendt på efterkrav.

Refusion

Hvis der er aftalt refusion, så bedes I sende jeres bankoplysninger, så vi kan overføre det aftalte beløb.

Fortrydelsesret

Der gives 14 dages fuld returret på varer købt i vores Webshop. Efter 24. November og før 24. december gives fuld returret indtil 14. januar.

Perioden regnes fra den dag, hvor du modtager ordren.

Returneringsomkostninger skal du selv afholde.

Fortrydelse skal anmeldes til os senest 14 efter købet og fra fortrydelsen skal I senest 14 dage efter returnere forsendelsen.

Meddelelsen skal gives pr. mail på energy@Kiteborne.dk. I meddelelsen skal du gøre os tydeligt opmærksom på, at du ønsker at udnytte din fortrydelsesret. Varens stand, når du sender den retur

Du hæfter kun for eventuel forringelse af varens værdi, som skyldes anden håndtering, end hvad der er nødvendigt for at fastslå varens art, egenskaber og den måde, den fungerer på. Med andre ord – du kan prøve varen på samme måde, som hvis du prøvede den i en fysisk butik.

Hvis varen er prøvet udover, hvad der er beskrevet ovenfor, betragter vi den som brugt, hvilket betyder, at du ved fortrydelse af købet kun får en del eller intet af købsbeløbet retur, afhængig af varens handelsmæssige værdi.

For at modtage hele købsbeløbet retur må du altså gøre det samme, som man kan i en fysisk butik. Du må afprøve varen, men ikke tage den i egentlig brug.

Server og data

Kunden har gratis online adgang til egne private samt kitebornes offentlige data via Kitebornes server.

Vedligeholdelse og opdatering af servere kan finde sted uden varsel under hvilket tidsrum kunden mister adgang til sensor data midlertidigt.

Denne gratis service kan tilendebringes indenfor rimelig varsling af kunden, dog kun velbegrundet med radikal ændring af virksomhedens ejerforhold eller ændringer i forretningsmodellen.
